South Korea passes subcontracting law revision, enabling suppliers to seek injunctions

( August 27, 2025, 07:24 GMT | Official Statement) -- MLex Summary: South Korea’s National Assembly today passed a revision to the Fair Transactions in Subcontracting Act introducing a private injunction system. The change allows subcontractors harmed by, or at risk of, unfair practices to petition courts directly for relief, without going through the Korea Fair Trade Commission. The law designates 12 categories of prohibited conduct eligible for injunctions, including unfair contract terms, coercive purchases, unjust cancellations, abusive payment practices and misappropriation of technical data. For technology theft cases, courts may also order disposal of goods or equipment used in the violation. The revision will take effect three months after promulgation and is intended to provide faster remedies to complement KFTC sanctions.The statement, in Korean, is attached....
