Google, TikTok say X Corp. decision supports dismissing US product-liability case

( August 15, 2025, 22:31 GMT | Official Statement) -- MLex Summary: Google and TikTok told a US federal judge that a recent decision against X Corp. in the Ninth Circuit confirms that Section 230 bars a product liability case over defects in their products because it's fundamentally premised on plaintiffs’ disagreement with the companies’ content moderation decisions. “Doe 1 neither adopted nor suggested a new paradigm where any claim directed at ‘reporting tools’ automatically survives Section 230. Rather, the case reaffirms the Ninth Circuit’s nuanced approach to Section 230, which “look[s] … to what the duty at issue actually requires: specifically, whether the duty would necessarily require an internet company to monitor third-party content,” they said.
