( August 18, 2025, 22:31 GMT | Official Statement) -- MLex Summary: Plaintiffs bringing US claims against Google and TikTok over the adequacy of reporting processes on their social media platforms said that a recent loss by X Corp. before the US Court of Appeals for the Ninth Circuit supports their argument that Section 230 does not immunize platforms from liability for defects in their own products, even if those products are related to content moderation. They argued that the panel distinguished the duty that applies to the design of the platform’s own interface as it interacts with users from the duty that applies to the platform’s role as a third-party content publisher, holding that platforms are not immunized by Section 230 against design defect and negligence claims that relate to the defects in reporting infrastructure.See attached file. ...
