American Express asks US court to dismiss antitrust complaint rife with 'flawed theories'

( July 24, 2019, 19:44 GMT | Official Statement) -- MLex Summary: The American Express Company told a US federal court that antitrust claims brought by a group of users should be dismissed because plaintiffs have no relationship with Amex — direct or indirect — and instead rely on a complicated multi-step theory of causation where they lack standing to assert all of their claims. Plaintiffs' complaint alleges "flawed theories" and further amendment would be "futile" and the court should grant dismissal with prejudice, Amex told the Eastern District of New York. "This is yet another purported class action challenging Amex’s non-discrimination provisions (“NDPs”) — essentially on the same basis as was asserted in the now-resolved lawsuits brought by the U.S. Department of Justice and by the 15 supermarket and drug store chain ... However, Plaintiffs are neither merchants nor Amex cardholders. Rather, they are consumers who allegedly made purchases using a different form of electronic payment," Amex said.See attached document....
