National trademark holders gain strength from new EU court decision

By Douglas Clarke-Williams ( August 7, 2025, 09:59 GMT | Comment) -- Retailers of trademarked goods in the EU and beyond could now be open to more enforcement action, after the EU’s highest court shut down the possibility that the infringing goods could be warehoused at arm’s length from the seller.On Aug. 1 the Court of Justice of the European Union ruled in TradeINN that retailers of goods trademarked in one member state were in breach of trademark law if they stored the goods in a country where the items did not enjoy trademark protection with the intent of selling them into one where they did (see here)....
