US states' intervention in Sandoz price-fixing settlement should be denied, special master says

( July 18, 2025, 23:00 GMT | Official Statement) -- MLex Summary: Special master Lawrence Stengel has recommended that a federal judge deny 43 US states and territories' motion to intervene in a settlement between Sandoz and end-payer plaintiffs that would resolve claims Sandoz engaged in price-fixing over generic pharmaceuticals. "I find that the States are seeking intervention to preserve their appellate rights, because they could have lodged their objections with the District Court through amicus briefing... the States are seeking a strategic advantage for a future litigation posture, rather than simply seeking to have the substance of their objections considered by the Court," the special master said in his filing to the Eastern District of Pennsylvania. The states have not met their burden to establish Article III standing, and their intervention is also likely to cause undue delay, Stengel said.See attached file....
