Meta might need to negotiate press fees in Italy, EU copyright opinion finds (update*)

The case brought by Meta Platforms Ireland against Italy’s communications regulator challenges the compatibility of national rules that oblige platforms to compensate publishers under the EU’s copyright law. Advocate General Maciej Szpunar found that EU countries have some leeway to support publishers’ rights, and measures like those in Italy are allowed if they preserve contractual freedom and don’t impose automatic payment obligations.Social media giant Meta can be required to negotiate with publishers and share data under Italy’s press compensation law, as long as such measures preserve contractual freedom, an adviser to the EU’s top court said today....
