Trump administration asks for full rehearing on PCLOB reinstatements

The DOJ said a special panel cannot hold that Congress’ decision to amend the PCLOB’s organic statute in 2007 to delete an at-will removal provision was irrelevant and ineffective. “The special panel’s magic-words requirement flatly contradicts this court’s holding […], and numerous Supreme Court decisions. And it imperils removal protections for other federal officers, like commissioners of the Securities and Exchange Commission, whom this court has held and the Supreme Court has long assumed Congress meant to insulate from presidential whim,” the agency said.See attached file. ...
