Brasserie Nationale loses appeal of EU review of drinks deal at EU court

( July 2, 2025, 08:00 GMT | Official Statement) -- MLex Summary: Luxembourg brewer Brasserie Nationale has lost its legal challenge to the European Commission's review of its takeover of drinks distributor Boissons Heintz. Brasserie Nationale argued that the Luxembourg competition authority had missed a deadline under EU merger rules that says member states must submit a referral request to the commission within 15 working days of them knowing about the deal. But in a ruling today, the General Court said the fact that the company had given the the authority “information limited to the mere existence of a concentration” did not constitute sufficient information to make the transaction "known" to the regulator.
