Emboline's UPC security-of-costs ruling in AorticLab case overturned on appeal

( June 20, 2025, 14:36 GMT | Official Statement) -- MLex Summary: Emboline, the claimant in a patent infringement case against AorticLab, has seen Unified Patent Court appeal judges overturn a ruling that required AorticLab to pay 200,000 euros ($230,000) in security for costs. The UPC Court of Appeal ruled that Article 69(4) of the UPC Agreement explicitly allows only defendants — not claimants, like Emboline — to request such security, as the provision aims to shield defendants from financially unstable claimants, not vice versa. The patent at the center of the dispute is Emboline's European Patent 2,129,425, covering a medical technology. See document attached....
