Poland’s pharmacy ad ban violates EU law, top court judges rule

By Júlia Tar ( June 19, 2025, 09:45 GMT | Insight) -- Poland’s ban on pharmacy advertising breaches EU rules by unjustifiably restricting pharmacists’ ability to promote their services online, the bloc’s top court ruled today. While professional standards may limit how such advertising is carried out, they cannot be used to impose a total prohibition, the judges said. The ban also undermines single market freedoms by making it harder for foreign-based pharmacists to enter the Polish market. The decision follows the European Commission’s referral to the court in 2023, alleging Poland’s pharmacy advertising breaches EU internal market rules.Provisions of the Polish pharmaceutical law that impose a ban on advertising by pharmacies and on the promotion of their services violate EU law, according to today’s ruling by the Court of Justice of the EU (see here)....
