US judge rules Google must face privacy claims for pre-2023 health data collection

( June 6, 2025, 19:29 GMT | Official Statement) -- MLex Summary: US District Judge Vince Chhabria ruled that a lawsuit claiming Google secretly collected sensitive health data can move forward, but only for conduct that occurred before the company updated its policies in 2023. The claims include alleged violations of federal and California wiretap laws, invasion of privacy, and misuse of personal health information through tracking tools installed on healthcare provider websites. After those updates, Chhabria ruled, plaintiffs could no longer reasonably argue that Google intentionally sought out such data. He also permitted part of a breach of contract claim to proceed, finding that Google may have broken its promise not to collect health information outside of the specific instances identified in Google’s Terms of Service and Privacy Policy. But a related claim accusing the company of using that data to target ads was thrown out for lack of evidence, along with a claim that Google breached an implied covenant of good faith.See attached ruling....
