Pharmacies ask US appeals court to fully strike CVS arbitration agreement
( June 4, 2025, 22:31 GMT | Official Statement) -- MLex Summary: Pharmacies asked a US appeals court to rule that Caremark’s arbitration provisions are unenforceable in their entirety in a case accusing CVS of illegally forcing pharmacies to pay to provide certain services through an illegal tying arrangement. The pharmacies said that the lower court was correct to strike certain provisions that make it infeasible for plaintiffs to pursue their substantive statutory rights under the antitrust laws and their other legal claims arising from the damage caused by Caremark. However, they asked the appeals court to strike the arbitration agreement in its entirety because the remaining provisions require them to incur risks of devastating loser pays judgments that are contrary to the scheme of the federal antitrust laws, and otherwise endure abusive and one-sided treatment in arbitration.See attached file. ...
