Shipbuilders request rehearing en banc over revival of US no-poach suit

( May 23, 2025, 22:51 GMT | Official Statement) -- MLex Summary: General Dynamics, Huntington Ingalls and other defendant shipbuilders asked the US Court of Appeals for the Fourth Circuit for a rehearing en banc of a decision that revived claims accusing them of conspiring not to recruit each other’s naval engineers. In a split decision, a Fourth Circuit judicial panel overturned a Virginia federal judge’s order dismissing the case on timeliness grounds. "Rehearing en banc of the divided panel decision is necessary because the panel majority opinion conflicts with Circuit precedent, splits from the precedent of other Circuits, and all but eviscerates the statute of limitations in conspiracy cases, especially in putative nationwide class actions like this one," the defendants argued in their petition. Petition for rehearing en banc attached. ...
