EU countries split over future of SEP law at ministers' council

By Inbar Preiss ( May 22, 2025, 17:26 GMT | Insight) -- At a meeting of EU industry and economy ministers, several countries led by Germany urged the European Commission to reverse its decision to withdraw a proposed regulation on standard essential patents. Other countries including Sweden, Finland and Croatia backed the withdrawal, warning the draft was too complex, risked overregulation and lacked sufficient political and industry backing. Several states suggested alternatives such as soft law approach or a revised proposal. Commission Executive Vice President Stéphane Séjourné acknowledged the divisions and asked the council to find a “middle way” moving forward.At today's quarterly meeting of EU member state representatives for trade and innovation, countries expressed their views on the commission’s intention to scrap its divisive draft legislation for standard essential patents....
