Amplitude files reply backing arbitration in US privacy, hacking case over SDK

( May 20, 2025, 22:31 GMT | Official Statement) -- MLex Summary: Amplitude filed a reply in support of its motion to compel arbitration in a US privacy, wiretapping and hacking litigation filed against its software development kit, saying that the opposition is a transparent effort to avoid the facts and the law. “Despite conceding that they agreed multiple times to the DoorDash terms & conditions, which contain an arbitration and delegation agreement, plaintiffs take a kitchen-sink approach to arguing that Amplitude cannot enforce the agreement. Plaintiffs ignore their own allegations in the first amended complaint, ignore recent decisions applying equitable estoppel to substantially similar claims, ask the court to set aside the test for equitable estoppel applied by the Ninth Circuit and California courts, misstate the T&C in an effort to claim it is unconscionable, and resort to mischaracterizations about Amplitude’s service,” it argued.See attached file. ...
