Amazon fulfillment center usage not enough for Texas venue in patent case

( May 19, 2025, 15:00 GMT | Official Statement) -- MLex Summary: A landscape equipment manufacturer and its owner won’t be haled into Texas court to defend allegations of patent infringement because venue is improper there, US District Judge Alan D. Albright of the Western District of Texas ruled. In granting a motion to dismiss by OPE Marketplace LLC, incorporated in Delaware, and Joseph Cohen, a New York resident, Albright agreed that OPE’s reliance on Amazon fulfillment centers in Texas is not enough. "Plaintiff offers no facts that OPE owns, controls, or operates those facilities, or that they are in any way 'places of the defendant'" under the framework established by the Federal Circuit in 2017's In re Cray, according to Albright. He went on to reject plaintiff Yuan Mei Corporation’s assertions of an alter ego relationship between OPE and the Texas-based All Season Power LLC, which remains a defendant in the case, where it is accused of direct and induced infringement of Yuan Mei's US Patent No. 7,422,162.See attached document....
