Workday AI discrimination claims win preliminary collective status

( May 16, 2025, 19:23 GMT | Official Statement) -- MLex Summary: Litigation alleging that Workday's use of artificial intelligence discriminated against people over age 40 has won approval from a federal judge for preliminary collective certification, allowing plaintiff Derek Mobley to notify similarly situated individuals of his lawsuit "The critical issue at the heart of Mobley’s claim is whether that system has a disparate impact on applicants over forty," US District Judge Rita Lin said in granting that status. "That issue is susceptible to common proof — it cuts across the proposed collective, regardless of the degree to which particular employers place weight on those recommendations, the extent to which the system makes discriminatory recommendations across different employers, or the natural variations in the qualifications or rejection rate for particular members of the proposed collective."
