US Justice Department issues revised corporate enforcement policies

( May 16, 2025, 17:19 GMT | Official Statement) -- MLex Summary: The US Department of Justice's Criminal Division issued a revised corporate enforcement and voluntary self-disclosure policy whereby the government will decline to prosecute a company for criminal conduct if it meets four factors: disclosing wrongdoing, fully cooperating with an investigation, remediating the misconduct and having a lack of aggravating circumstances. If there is a "near miss," as defined under the policy, a company can get a non-prosecution agreement or other credits. In other cases where a company fails to meet the criteria, prosecutors have discretion to determine the appropriate resolution, according to the policy memo.Document attached....
