Post-Brexit ‘UK+’ IP exhaustion regime reigns supreme, will be made permanent

The news flows from a consultation launched by the prior government that offered stakeholders four options to choose from. A majority indicated their preference for maintaining “UK+” — by which IP rights are exhausted once products are placed on the market in the UK or the European Economic Area. But a lack of quantitative data on parallel trade may have played a part in the outcome, and at least one leading think tank says the approach could be a consumer unfriendly breach of the UK’s obligation to the World Trade Organization.Genuine goods can be lawfully resold in the UK without the blessing of intellectual property owners so long as they emanate from the UK or the European Economic Area....
