Disney faces no shortage of hurdles in US antisuit injunction request

By Melissa Ritti ( May 13, 2025, 23:24 GMT | Comment) -- Longstanding US Fifth Circuit precedent counsels against granting Walt Disney Co.’s request that a California federal judge bar enforcement of an injunction that could flow from patent infringement proceedings abroad, InterDigital argued last week. While more recently the Federal Circuit — vested with exclusive jurisdiction over US patent appeals — eased the standard for antisuit injunctive relief, its October 2024 decision is unlikely to pose a serious threat to Brazilian litigation which could see Disney+ enjoined as early as next month.The propriety of antisuit injunctions, or ASIs, in disputes over patent infringement is again on the docket in the US, this time in a dispute over encoding techniques utilized during media streaming....
