SAP argues dismissal of Celonis's US antitrust claims over enterprise resource planning

( May 8, 2025, 12:00 GMT | Official Statement) -- MLex Summary: SAP, an enterprise resource planning company, told a California federal judge that its antitrust dispute with Celonis belongs in Germany because the challenged conduct originated at SAP's headquarters in Germany, and that regardless, Celonis "does not state a cognizable theory under any theory advanced." Celonis "tries to recast a refusal-to-deal theory as something else," but governing law bars the imposition of a duty on SAP to share its proprietary interfaces and technical support with a rival, the reply supporting dismissal filed to the Northern District of California said. The plaintiff's tying, bundling and predatory-pricing theories fare no better, as Celonis does not identify any one customer that was forced to choose a SAP product as a condition of accessing their own data, nor a transaction priced below SAP's incremental costs, nor factual allegations that would establish a dangerous probability of SAP monopolizing the "process mining" sub-market, the filing said.See attached document....
