Shipbuilders' win in engineers' no-poach suit reversed by US appeals court

( May 9, 2025, 21:27 GMT | Official Statement) -- MLex Summary: General Dynamics, Huntington Ingalls, smaller shipbuilders and specialized consulting and recruiting firms must face no-poach allegations anew after the US Court of Appeals for the Fourth Circuit reversed a lower court's order dismissing the case. "We hold that neither logic nor our precedent supports distinguishing between defendants who destroy evidence of their conspiracy and defendants who carefully avoid creating evidence in the first place," in a split decision authored by US Circuit Judge James Andrew Wynn. In his dissenting opinion, US Circuit Judge Albert Diaz said the majority erroneously applied the "self-concealing standard" when assessing the issue of fraudulent concealment.See attached document....
