General Cigar ‘Cohiba’ trademark cancellation upheld in win for Cuban brand

By Nick Robertson ( May 9, 2025, 16:39 GMT | Insight) -- A Virginia federal judge dismissed with prejudice General Cigar’s attempt to reverse the Trademark Trial and Appeal Board's cancellation of its “Cohiba” trademark for cigars in a win for Cuba’s Empresa Cubana del Tabaco, closing a chapter in a 28-year trademark fight. The judge wrote that the TTAB’s cancellation was proper under the Pan American Convention and was allowed despite sanctions against Cuba. The Trademark Trial and Appeal Board’s 2022 cancellation of General Cigar’s “Cohiba” trademark was proper, a Virginia federal judge ruled Wednesday, dismissing with prejudice the company’s attempt to overturn the cancellation. The ruling represents a major victory for Cuban state-owned tobacco firm Empresa Cubana del Tabaco (Cubatabaco) after more than 25 years of trademark litigation between the parties....
