Grundfos Holding pump patent infringed by Chinese rival, UPC finds
By Melissa Ritti ( May 8, 2025, 14:56 GMT | Insight) -- Belated introduction of new prior art and argument surrounding its application by a nullity counterclaimant at the Unified Patent Court must be accompanied by a showing of good cause why the material could not have been presented earlier and that its introduction is not prejudicial to patent owners, the local division in Düsseldorf said today. Because China’s Hefei Xinhu Canned Motor Pump Co. failed to make that showing, the UPC refused to consider its reliance on a variety of references — raised for the first time in a reply brief — and instead declared the defendant an infringer of a centrifugal pump patent owned by Denmark’s Grundfos Holding A/S. The decision reinforces the "front-loaded" approach to proceedings at the court.The Unified Patent Court's local division in Düsseldorf today refused to consider prior art raised by Hefei Xinhu Canned Motor Pump Co. in a nullity action it initiated after being sued by Grundfos Holding A/S for patent infringement, because the references were introduced to the litigation too late....
