Wesley Financial unentitled to jury trial in Diamond Resorts’ US false ad case

If the dispute between Diamond Resorts and Wesley Financial over an alleged scheme to induce property owners to break their timeshare agreements does make it to trial next year, it will be before a judge — not jurors.A request for disgorged profits to remedy false advertising under the Lanham Act is equitable, extinguishing the Seventh Amendment right of defendants to a trial by jury, US Judge Clifton L. Corker of the Eastern District of Tennessee ruled yesterday....
