WIPO Genetic Resources treaty will face substantial pushback in US

By Melissa Ritti ( April 29, 2025, 12:01 GMT | Comment) -- A hearing at US Patent and Trademark Office headquarters today on heightened international disclosure requirements for inventions that make use of genetic resources or associated traditional knowledge could be little more than a formality. Stakeholders appear largely opposed to the measure, setting the stage for a rare US break with the World Intellectual Property Organization. While the disagreement is uncommon, it is at least topically consistent — the US remains a noteworthy holdout, joined only by the Holy See, to the 1993 Convention on Biological Diversity and its 2014 subsidiary Nagoya Protocol for regulating access to genetic resources.The US, as an original signatory to the Convention Establishing the World Intellectual Property Office, has more or less stayed in lockstep with the UN’s IP wing since its inception in 1968....
