California utilities commission says it has immunity from US antitrust complaint

( April 26, 2025, 00:09 GMT | Official Statement) -- MLex Summary: The California Public Utilities Commission, or CPUC, has filed a motion to dismiss a Pacific Gas and Electric consumer's US antitrust complaint alleging that it participated in an illegal conspiracy to issue an anticompetitive and unlawful decision. In its motion-to-dismiss, CPUC said the details surrounding the conspiracy alleged in Michael Boyd's complaint, "are not specific enough to meet general pleading standards." In addition, CPUC argued that the commission and other commission defendants "have immunity in this Court under the Eleventh Amendment and Parker state-action doctrine from the only federal claim at issue." CPUC motion attached. ...
