Samsung asks director to clarify retroactivity of PTAB discretionary denial policy

The company argued that because the petitions were denied the same day the PTAB announced that its change in policy regarding discretionary denials was retroactive, it did not have an opportunity to respond and, therefore, was not afforded due process.Samsung asked US Patent and Trademark Office Acting Director Coke Morgan Stewart yesterday to review the denial of four of its inter partes review petitions at the Patent Trial and Appeal Board, arguing that the company was not afforded due process when the board discretionarily denied its petitions under new guidelines last month....
