PTAB cancellation of Qualcomm patent claims reversed by US Federal Circuit
By Melissa Ritti ( April 23, 2025, 21:03 GMT | Insight) -- In its second time weighing in on the validity of a Qualcomm integrated circuit patent, the US Court of Appeals for the Federal Circuit today — also for the second time — said the Patent Trial and Appeal Board erred in its handling of applicant admitted prior art presented in two 2018 petitions for inter partes review by Apple. Unlike their 2022 decision to vacate and remand, however, the panel this time reversed outright the PTAB’s determination of obviousness.The role of applicant admitted prior art (AAPA) in inter partes review, or IPR, was clarified today following two attempts to do so by the US Patent and Trademark Office — neither of which seemed to garner much support from the US Federal Circuit Court of Appeals....
