Lawsuit by disgruntled patent applicant ‘totally without merit,’ UK court says

( April 22, 2025, 11:24 GMT | Official Statement) -- MLex Summary: Claims of malice and corruption leveled by Malaysian inventor Othman Bin Ahmad, whose application to patent a hybrid vehicle was denied by the UK Intellectual Property Office in 2020, were rejected by UK High Court Judge James Mellor. While the UKIPO’s six-year delay in issuing its rejection was “regrettable,” Mellor said Ahmad’s decision to file suit instead of appealing directly to the UKIPO was procedurally improper. Moreover, according to Mellor, Ahmad’s complaint fails to articulate a cause of action against the office but even if it had, the Comptroller-General of Patents, Designs and Trade Marks “would enjoy immunity.” Ahmad “has only himself to blame” for the refusal of his patent application, Mellor ruled, ordering the plaintiff to pay the approximately $26,750 in costs incurred by the UKIPO in connection with his “utterly meritless” lawsuit.See attached document....
