US judge grants Google motion to strike class allegations in US copyright case

( April 21, 2025, 18:32 GMT | Official Statement) -- MLex Summary: Google's motion to strike class allegations in US copyright litigation accusing the company of illegally using writers' works to train its AI models has been granted by US District Judge Eumi K. Lee in San Jose, California. The writers' "fail-safe" class definition is defective as a matter of law, Lee said, but she gave them permission to amend. Under their current class definition, the court "cannot determine who is a member of the class without deciding the merits of each potential class member’s claim, including whether the potential class member has a valid copyright registration, whether Google infringed the class member’s work(s), and whether Google has a valid defense based on fair use or license (among other possible defenses)," Lee said. See attached file....
