UPC appellate judges deny Kodak’s bid to suspend injunction in Fujifilm dispute

( April 17, 2025, 13:13 GMT | Official Statement) -- MLex Summary: Kodak's application to suspend the enforcement of an injunction against it has been denied by the UPC Court of Appeal. The photographic film company wanted to pause the impact of the permanent injunction ordered earlier this month, while it pursues its main appeal against the decision that found it liable for infringing Japanese competitor's Fujifilm’s EP 3,511,174. The court said that an appeal does not automatically have suspensive effect unless justified by exceptional circumstances. Kodak had failed to demonstrate manifest errors in the original decision, according to the judges.See court document attached....
