Post-Brexit evidence gap limits Ritz Hotel’s EU trademark challenge

By Inbar Preiss ( April 17, 2025, 11:53 GMT | Insight) -- The Ritz Hotel in London has managed to block a small part of Swiss wholesaler Ritz Enterprise’s EU trademark application, with the European Union Intellectual Property Office ruling that the hotel’s UK-based reputation no longer counts toward distinctiveness in the EU post-Brexit. The opposition was upheld only for tobacco-related retail services, where the hotel’s “Ritz London Cigars” mark prevailed. For other categories — including clothing, printed materials, and advertising — the application may proceed.The Ritz Hotel in London came out with mixed results in its bid to block an EU trademark application, after the European Union Intellectual Property Office ruled that the hotel’s reputation in the UK could not be used to support its opposition in the EU post-Brexit....
