Ross Intelligence says AI copyright row over Westlaw a good fit for early appeal

( April 15, 2025, 18:18 GMT | Official Statement) -- MLex Summary: In a petition for permission to move forward with an interlocutory appeal, Ross Intelligence told the US Court of Appeals for the Third Circuit that it should declare its use of Thomson Reuters' Westlaw database in training an AI legal search engine transformative and, thus, fair under Section 107 of the Copyright Act. Additionally, Ross says, Westlaw’s headnotes are unoriginal and unentitled to copyright protection. All three statutory requirements for interlocutory appeal are satisfied, according to Ross, because the dispute presents a controlling question of law for which there is a substantial ground for a difference of opinion, and resolution of that question would materially advance the litigation. Judge Stephanos Bibas, also of the Third Circuit but assigned to the case as a visiting judge in the District of Delaware, granted Ross permission to pursue interlocutory appeal of his February 2025 summary judgment on April 4.See attached document....
