Siltronic fails to overturn UPC order allowing invoice seizure

( April 16, 2025, 10:57 GMT | Official Statement) -- MLex Summary: The Unified Patent Court has rejected Siltronic AG’s application to overturn an earlier order, which allowed Bekaert Binjiang Steel Cord Co. to inspect and preserve evidence in relation to the suspected infringement of EP 3,212,356 related to saw wires. The Düsseldorf Local Division confirmed that the original October 2024 order was appropriate, including the seizure of documents such as delivery bills and invoices. The judges said that preservation of evidence may serve to prove individual acts of use, and that such measures can extend beyond the non-exhaustive list in Rule 196.1 of the Rules of Procedure. The court found that Bekaert’s interest in securing evidence was justified, despite arguments that the company could have pursued alternative avenues, such as test purchases or recycling channels.See court document attached....
