Plaintiffs ask US appeals court to restart crop chemical antitrust case

( April 14, 2025, 17:51 GMT | Official Statement) -- MLex Summary: Plaintiffs bringing US antitrust claims against Bayer Corteva, Cargill, Corteva and other chemical producers over “crop protection chemicals” asked an appeals court to revive their case, saying that the lower court improperly applied the summary judgment standard to evaluate their complaint. “Plaintiffs adequately, and with sufficient particularity as to each defendant, alleged that defendants participated in and perpetuated a group boycott conspiracy. That some facts may have been alleged collectively is not improper given the collective nature of defendants’ conduct. Likewise, there is no requirement that conduct must be alleged to be in lockstep, simultaneous, or identical to be parallel,” they said. See attached file. ...
