Addition of TGI UK in AIM Sport patent dispute upheld by UPC appeal court

( April 11, 2025, 10:17 GMT | Official Statement) -- MLex Summary: The Court of Appeal of the Unified Patent Court has dismissed TGI Sport’s challenge against a lower court order, which allowed AIM Sport to amend its statement of claim and add TGI Sport Virtual UK Limited as a co-defendant. The court found that the Helsinki Local Division had acted appropriately, and that the amendments — including expanded territorial scope, new legal theories and the joinder of TGI UK — were justified and procedurally efficient. The appellate court also rejected TGI’s arguments of procedural unfairness, noting that the proceedings had effectively restarted and the defendants faced no undue hindrance in their defense.See UPC order attached....
