EU top court adviser urges fair access for heirs in filmmakers’ copyright dispute

( April 10, 2025, 15:15 GMT | Official Statement) -- MLex Summary: In a case brought by the heirs of film director Claude Chabrol and screenwriter Paul Gégauff, an adviser to the EU Court of Justice has suggested that the French court handling the case should ensure that procedural rules don’t make it too difficult — or even impossible — for the co-authors or their heirs to defend their rights. Advocate General Manuel Campos Sánchez-Bordona said that all co-authors must be called to participate in the proceedings. His non-binding opinion recommends that the Court of Paris consider that “the right of the joint right holders to defend their claims … must not be subject to procedural requirements that are impossible or very difficult to comply with.”See EU Court of Justice opinion attached. The case number is C-182/24....
