Uphold trademark dismissal in post-Brexit case, EU legal opinion says

( April 10, 2025, 14:02 GMT | Official Statement) -- MLex Summary: The EU Court of Justice should dismiss the EU Intellectual Property Office's appeal against opposition proceedings related to the registration of the figurative mark "Ape Tees," following the UK's withdrawal from the EU, according to a legal opinion prepared for the court. The non-binding opinion by Advocate General Tamara Ćapeta indicates that the EUIPO could not dismiss Nowhere's opposition based solely on the date of the contested decision, as the earlier UK rights were capable of forming the basis of an opposition during the period from June 30, 2015, to Dec. 31, 2020, before the UK's withdrawal from the EU took effect.
