VLSI urges US judge to declare Intel ‘due diligence’ theory waived

While the underlying motion to file a supplemental brief remains under seal, along with Intel’s response, VLSI’s reply yesterday was not. In it, the nonpracticing entity says Intel conceded at the hearing before a Texas federal judge that VLSI “never adopted or authorized” a settlement with Finjan Software Inc. and Finjan Inc., which Intel intends to rely on to establish that its use of VLSI’s patents is licensed. “The inquiry ends there,” VLSI says.VLSI yesterday urged a Texas federal judge to reject as waived an “eleventh-hour attempt” by Intel to “resurrect” claims that Intel’s 2012 settlement with Finjan Inc. and Finjan Software, Inc. was “adopted” by VLSI by extension, when VLSI was created by Fortress Investment Group in 2016....
