Amazon motion for judgment on the pleadings rejected in US FTC antitrust case

( April 8, 2025, 23:02 GMT | Official Statement) -- MLex Summary: Amazon was unsuccessful in its attempt to get a Washington federal judge to enter judgment for the company on all of the US Federal Trade Commission’s claims in their monopolization dispute. Amazon contended that the FTC lacks statutory authority to seek a permanent injunction in federal district court without a pending administrative proceeding. In a five-page order filed today, US District Judge John Chun said that FTC v. H.N. Singer "remains binding law." In that case, the Ninth Circuit held that section 13(b) of the FTC Act  "gives the Commission the authority to seek, and gives the district court the authority to grant, permanent injunctions in proper cases even though the Commission does not contemplate any administrative proceedings," Chun noted. The judge also said that because his order doesn't involve a legal question "as to which there is substantial ground for difference of opinion," he was also denying Amazon’s request for certification of the interlocutory appeal.
