Tesla, Musk can’t shake US direct infringement claim over ‘Blade Runner’

( April 7, 2025, 18:18 GMT | Official Statement) -- MLex Summary: A dismissal request by Tesla and Elon Musk of direct and contributory copyright infringement allegations was denied but Alcon Entertainment’s vicarious infringement and false endorsement claims have been deemed fatally deficient by US District Judge George H. Wu of the Central District of California. The parties, together with Tesla co-defendant Warner Bros. Discovery, were ordered to engage in settlement talks. If they bear no fruit, Wu indicated Alcon will likely be denied leave to amend its now-dismissed Lanham Act claim, but that his other dismissals will be without prejudice. Warner Bros., unlike Tesla, did win dismissal of Alcon’s copyright claims in full. At issue in the dispute is an unauthorized use by Tesla and its founder Elon Musk of Alcon Entertainment’s film “Blade Runner 2049” during its promotion of the “Cybercab.” Wu issued a tentative ruling on the defendants’ motions to dismiss which was followed by a hearing and in chambers order.See attached documents....
