Italian sculptor, cleared of copyright liability, dodges US Supreme Court review

( April 7, 2025, 16:07 GMT | Official Statement) -- MLex Summary: Copyright infringement allegations by Joe Morford against Italian sculptor Maurizio Cattelan won’t be argued before the US Supreme Court, who denied a petition for writ of certiorari in the case. At issue is an August 2024 decision by the Eleventh Circuit US Court of Appeals which affirmed a summary judgment in favor of Cattelan, accused of copying Morford’s art installation comprised of a banana duct-taped to a wall. In seeking High Court review, Morford presented two questions: “Can portions of artwork establish striking similarity?” and “Must artwork be popular, prosperous or promoted to be reasonably accessible online?” The appellate court joined US Judge Robert N. Scola Jr. of the Southern District of Florida in concluding Cattelan’s work, “Comedian,” was not strikingly similar to Morford’s “Banana and Orange.”See attached document....
