US Federal Circuit again remands trade secret damages for TAOS

( April 7, 2025, 16:13 GMT | Official Statement) -- MLex Summary: The US Court of Appeals for the Federal Circuit remanded monetary damages in a trade secret suit for a second time in a precedential opinion, a decade after a Texas jury found Intersil (now Renesas Electronics America) liable for misappropriation of trade secrets for screen-brightness technology owned by TAOS (now ams-OSRAM).  The appeals court first affirmed a verdict against TAOS in 2018, remanding monetary damages for further proceedings based on a more limited theory of disgorgement. Following a new jury trial, both parties appealed to the Federal Circuit again.  The panel affirmed the damages for the most part, but wrote that the district court erred again in how it calculated disgorgement. That miscalculation didn't change the final sum of damages, however. The court did remand as to the issue of prejudgment interest, also finding that the district court erred in its calculation.See opinion attached....
