US judge applies Lanham Act to foreign sales in win for Kinwong Electronic

By Melissa Ritti ( April 7, 2025, 14:29 GMT | Insight) -- Following a 2023 bench trial a Florida federal judge said Friday that Rishi Kukreja, Kinwong LLC, and Circuitronix defrauded the US Patent and Trademark Office when registering “KINWONG” in the US and conspired to sell counterfeit Kinwong-branded printed circuit boards to US-based parent companies. The defendants’ passing-off scheme warrants an award of damages in favor of plaintiffs Shenzhen Kinwong Electronic Co., Ltd. and Kinwong Electronic (Hong Kong) Ltd., even for foreign sales to “middlemen” subsidiaries. To hold otherwise, the judge ruled, would create a “gaping chasm” in the Lanham Act.Two Hong Kong-based plaintiffs secured $5.2 million in damages on Friday in a longstanding row over the “KINWONG” trademark....
