Austrian data disclosure case raises question on GDPR erasure right at EU court

( April 7, 2025, 15:18 GMT | Official Statement) -- MLex summary: An Austrian court has asked the EU's highest court if an individual can invoke a "right to erasure" in the EU's data privacy rules when only requesting that a company stop forwarding personal data that has been unlawfully disclosed. At issue is whether the "right to erasure" in the EU's General Data Protection Regulation's Article 17 can be invoked by an individual against Austrian credit agency CRIF GmbH. The Austrian court asks the European Court of Justice whether a data processing injunction can be ordered when erasure hasn't been asked and would be against the data subject's interests. This issue arises because a failure to appear in CRIF's database could influence business decisions.  The excerpt from the Official Journal follows....
