Samsung loses bid to dismiss Fingon suit at UPC over patent opt-out issues

( April 4, 2025, 14:24 GMT | Official Statement) -- MLex Summary: In response to a preliminary objection raised by Samsung in an infringement case brought by Fingon, the Unified Patent Court clarified that the UPC has jurisdiction over acts committed before the UPC Agreement's entry into force and during the period between an opt-out and its withdrawal. Samsung had challenged the jurisdiction of the UPC over alleged infringements that occurred prior to June 1, 2023 and during the time the patent was opted out of the UPC system. The Mannheim Local Division rejected the preliminary objection and denied requests to stay proceedings. The case concerns Fingon's European Patent 2,839,403.See court document attached....
