Spanish clock for cartel claims starts once decision is final, EU court opinion says

( April 3, 2025, 09:32 GMT | Official Statement) -- MLex Summary: EU cartel laws don’t preclude Spanish rules saying that the clock for bringing a damages action doesn’t start until a decision by the competition authority finding an infringement has “become final,” according to a legal opinion prepared for the bloc’s top court today. Advocate General Laila Medina said that injured parties may not have sufficient information to bring a claim until the competition watchdog’s decision has been given “probative value” by national courts. Spanish judges have asked the EU Court of Justice for guidance on a claim against Nissan, which Nissan argues is out of time as it was filed more than one year after the Spanish competition authority published its decision on its website.The Advocate General's opinion is attached.
