Apple’s iPhone users urge Ninth Circuit to reverse order dismissing US antitrust suit

( March 31, 2025, 22:31 GMT | Official Statement) -- MLex Summary: A California federal court erred when it held that Apple's express contractual agreements with developers weren't subject to Section 1 of the Sherman Act, a putative class argued to an appellate court in litigation challenging Apple's alleged dominance in the markets for smartphones and smartphone operating systems. In a reply brief filed with the US Court of Appeals for the Ninth Circuit, the putative class wrote that the district court's order dismissing its complaint should be reversed and that the case should be remanded for further proceedings. The "district court erred when it held that Plaintiffs lacked Article III standing to seek an injunction remedying the anticompetitive effect of Apple’s WebKit agreements," the putative class argued.  See court document. ...
